How Avenia Studio uses your details

Who I am

Avenia Studio is run by me, Jacob Dan, a sole trader based in Denmark. I'm responsible for your details.

What I have and where it came from

If I've emailed you about your website, I have your business name, company number, town, web address, business email and phone number and, if it's shown publicly, your name. I found your business on Google Maps, your email on your own website, and checked your company on Companies House. I also note what I saw on your website, your Google rating, and the emails between us. If someone at your business pointed me to you, I have the name and email they gave me.

Why I use it

To offer your business a new website. My interest is finding customers for my web design work, and the law calls this "legitimate interests" (Article 6(1)(f) of the UK GDPR and the GDPR). I only use business contact details, I email you about your business, and you can stop it at any time.

If you ask me for the free draft, I use your details to make it for you, because you asked (Article 6(1)(b)).

If you become a customer, I use your details to build and look after your website and to send invoices (contract and legal obligation). I need your contact details and materials to do the work; without them I can't deliver the website.

Who else sees it

I don't sell or give your details to anyone. I use a few service providers to send email, host my website, store data and run my tools, such as Google, Microsoft, Cloudflare, Instantly, Anthropic and OpenAI. They work for me under written data processing agreements. If you become a customer, Stripe handles payments and my accountant sees invoices, and both are responsible for the data they handle themselves.

Some of these providers are in the USA. The transfer is protected by the UK-US "data bridge" and the EU-US Data Privacy Framework, or by approved standard contract terms. Ask me and I'll send you a copy of the safeguards.

How long I keep it

If you don't reply, or we don't end up working together, I delete your details 6 months after our last contact. I keep your company number, web address and the date I first emailed you for 2 years, so I never email you again by mistake.

If you tell me to stop, I delete your details except your email address, web address, company number, the date and the reason, which I keep on a "do not contact" list for as long as I send emails like this.

If you complain or ask about your data, I keep that and my reply for 3 years.

If you become a customer, I keep your details while I look after your website and for 6 months after, and invoices and payment records for 5 years after the end of the financial year, as Danish law requires.

If you visit my website

My website doesn't use cookies or tracking. Cloudflare, which hosts it, processes your IP address to show you the pages and protect the site from attacks (legitimate interests). I don't use it to find out who you are.

Your rights

You can ask me for a copy of your details, and ask me to correct them, delete them, or limit how I use them. You can object to how I use them at any time, and you can always say no to marketing: reply "no thanks" and you won't hear from me again. If you're a customer, you can also ask for your details in a format you can take elsewhere.

Complaints

If you're unhappy with how I've handled your details, tell me any way you like, for example by email to jacob@aveniastudio.co.uk with "Complaint" in the subject line. I'll confirm I've got it as soon as I can, and within 30 days at the latest, and then give you a full answer.

You can also complain to the UK regulator, the Information Commission (ICO), at ico.org.uk, or to the Danish Data Protection Agency, Datatilsynet, at datatilsynet.dk.
